STAGE 3. Work Visa application

 

After approval of the sponsoring business and nomination occupation, the potential overseas worker may now proceed with the application for the working visa upon satisfaction of the general requirements which are as follows:

 

  • Have the minimum skills requirements for the occupation, position, or role.
  • For subclass 482 TSS visa, it is a requirement that the applicant have worked at least full-time for 2 years in the nominated occupation and a positive skills assessment.
  • For subclass 494 visa, it is likewise required that the applicant have worked in the same occupation for at least full-time for 3 years.
  • Applicants who are originally from non-English speaking countries must show evidence of minimum required English proficiency.

 

Once approved, the overseas worker can work in the nominated occupation for the duration of the approved work visa.

 

The sponsoring business must also comply with the Australian Employment Law while employing an overseas worker by continually providing at least the minimum salary or the relevant market salary rate for sponsored work visas, payslips, superannuation entitlements and taxation documentation to the sponsored employee, safe workplaces and pay legal rates, allowance for leave conditions, and follow legal dismissal processes to which Australian employees would be entitled.
