What is a 482 Visa?

 

The 482 Temporary Skill Shortage (TSS) Visa is a popular choice of visa for highly qualified overseas workers who wish to work and even bring their families to Australia. This visa program came into effect on 18 March 2019, at which the Temporary Work Skilled 457 visa program ceased accepting new applications.

 

According to the 31 December 2021 (Summary of Key Statistics and Trends) by the Department of Home Affairs, there were 15,760 applications lodged in 2021-22 and 14,390 applications granted in the same period.

 

The top occupational ANZSCO groups which were granted 482 visas are Professionals, Technicians and Trades Workers, and Managers. Visas granted were mostly coming from the Information Media and Telecommunications, Professional, Scientific, and Technical, Health Care and Social Assistance industries. The top three occupations were Software Engineer, Chef and Resident Medical Officers and the Top three locations for nominated positions are New South Wales, Victoria, and Queensland.

Given the popularity of the 482 TSS visa and its pathway to permanent residence, many overseas workers consider this visa as their golden ticket to Australia. Aside from the opportunity to live and work in Australia, 482 TSS holders can also bring their family members, including spouses and children with them and they will enjoy the same rights as the primary visa holder, including being able to work and study in Australia.

 

How can I apply for a 482 Visa?

 

Step 1.  Check your Qualifications. Your occupation should be listed on the consolidated Skilled Occupation List, and you must have at least two (2) years of work experience in the nominated occupation.

 

Step 2. Meet the Eligibility Requirements.

 

  • Meet the minimum English language proficiency requirement, unless exempt
  • Satisfy the DHA requirement for health and good character
  • If in Australia, must have a substantive visa or a bridging visa and have complied with the visa condition

Note: There is no age requirement for TSS 482 Visa

 

Step 3. Be Sponsored by an Approved Australian Business. The approved business sponsor must be lawfully operating business in Australia for at least two (2) years, have no adverse information against the business, must be reputable and have a good record when it comes to taxation obligations and must satisfy the salary and employment condition related requirements (salary justification report) and provide evidence of labour market testing when required.

 

Step 4. Getting nominated for the occupation by the employer. Once you find an employer who is willing to sponsor you via TSS 482 visa, the employer can complete the Employer Sponsorship Application online through the Department of Home Affairs (DHA). Click here to know more about this process.

Versions of 482 Visas.

 

The short-term stream TSS 482 Visa – The occupations are listed in the Short-Term Skills Occupation List (STSOL). This visa is for 2 years. If an international trade obligation applies, this visa may be granted for up to 4 years.

 

The Medium-term stream TSS 482 Visa – The occupations can be found in the Medium and Long-Term Strategic Skills List (MLTSSL) and this visa is for 4 years. Holders of this visa stream are eligible to apply for permanent residence. This vis stream is aimed at overseas skilled workers in a skilled occupation that the government of Australia believes is critically needed and will be needed in the long term.

 

Labour Agreement TSS 482 Visa – Under this program, Australian employers can hire overseas skilled workers in line with the commonwealth agreement.

 

 

How can I renew a 482 Visa?

 

The good thing about this visa is that you can re-apply several times if the conditions are met, as there is no limitation as to how many times one can renew a 482 Visa. For medium-term and labour agreement visas, you may lodge your application offshore or onshore in Australia.  For a short-term stream, you may apply offshore.

 

For visa holders granted under the occupations on the Short-Term Skills Occupation List (STSOL), the visa holder can re-apply for a further two (2) year 482 TSS Visa.

 

For those visa holders under the occupations on the Medium and Long-Term Strategic Skills List (MLTSSL), the visa holder may renew for a further four (4) years.

 

Renew 482 Visa or Transition to Permanent Residency?

 

Medium and Long-Term Strategic Skills List (MLTSSL), the visa holder can also transition to permanent residency through the Employer-Sponsored Temporary Transition Stream (ENS/RSMS) provided that the 482 TSS visa holder have worked for the same employer for three (3) years under the 482 TSS visa and have worked in the same occupation for three (3) years on that visa, have at least competent English (ELTS 6 in each band or equivalent) – certain exemptions apply, and the 482 TSS visa holder is under 45 years old at the time of applying for permanent residency.

 

It is important to note, however, that even though it is required that the applicant is under 45 at the time when applying for permanent residency through the transition stream, there is no age limit for application in the 482 TSS Visa in general. You can still apply for a 482 TSS visa even if you are 50 years old.

 

Given the work experience of two (2) years full time in the relevant occupation, fresh graduates (international Students) from Australian Universities are not eligible to apply for the 482 TSS visa but instead can opt to apply for the 485 Temporary Graduate Visa for recent graduates under the Post-Study workstream and Graduate workstream.
