What is a 482 Visa?

 

Applying for TSS 482 Visa, to stay and work in Australia is a straightforward process once the employers Nomination stage is lodged.

 

Step 1.  Check your Qualifications. Your occupation should be listed on the consolidated Skilled Occupation List, and you must have at least two (2) years of work experience in the nominated occupation.

 

Step 2. Meet the Eligibility Requirements.

 

  • Meet the minimum English language proficiency requirement, unless exempt
  • Satisfy the DHA requirement for health and good character
  • If in Australia, must have a substantive visa or a bridging visa and have complied with the visa condition

Note: There is no age requirement for TSS 482 Visa

 

Step 3. Be Sponsored by an Approved Australian Business. The approved business sponsor must be lawfully operating business in Australia for at least two (2) years, have no adverse information against the business, must be reputable and have a good record when it comes to taxation obligations and must satisfy the salary and employment condition related requirements and provide evidence of labour market testing when required.

  • Labour Market Testing Labour Market Testing (LMT) is the process whereby the Employer assesses (tests) the availability of candidates related to their potential Migrant Employee’s nominated role, prior to pursuing the Sponsorship of a Visa for a new Migrant Employee. It usually involves advertising and shortlisting applicants.   • Salary Justification Reports – This is a comprehensive report submitted by the sponsor business/employer to show that the nominated salary is falling within the Annual Market Salary Rate requirement. Various factors are taken into consideration to craft the report, such as skill level, location, qualifications, experience, and other variables to prove that the employee is neither underpaid or overpaid (as compared to any other currently Australian Citizen or Permanent Resident Worker).

 

  • Genuine Position Statement – This is a requirement that addresses the requirement to prove that there is a genuine need of the nominated position in the business. It is important to illustrate to the assessing Case Officer what the history and context of the role is, justification that the role hasn’t been created to achieve a visa outcome for the migrant, how the role relates to the scope of the business and its benefit, the migrant’s suitability for the role, how it relates to the ANZSCO Code for ABS standards, and other crucial elements.

 

  • Position Description – Position Descriptions must be aligned to what the Department (using guidelines from the ABS) deems to be as the majority of suitable duties and responsibilities for each unique job/position. It is highly ideal that the Position Description Document is aligned with the ANZSCO Code requirements, meet all DHA requirements and should be consistent with the industry concerned.

 

Step 4. Getting nominated for the occupation by the employer. Once you find an employer who is willing to sponsor you via TSS 482 visa, the employer can complete the Employer Sponsorship Application online through the Department of Home Affairs (DHA). Click here to know more about this process.
